Terms of Business

These terms of business replace all previous versions. We reserve the right to change these terms at any time without notice. Such changes made to these terms will take immediate effect. These terms are an agreement between you and Next Day Flooring UK. By making any transaction with us you are deemed to accept these terms in full.

Definitions

www.nextdayflooringuk.co.uk, “Us”, “Our” and “We” all refer to this website or the owner of it.

 “You” refers to you the visitor and/or customer.

“Website” refers to this website (www.nextdayflooringuk.co.uk).

Signatures

All deliveries require a signature upon receipt. If there is no answer and nobody is available to provide a signature and the goods are taken away we reserve the right to levy a charge for re-delivery.

If goods are left upon your request without a signature we are unable to accept any liability for loss or damage.

Kerbside Only Deliveries

All deliveries are “one man” kerbside only deliveries. Delivery drivers are under no obligation to take goods into a customer’s property, this is entirely at their discretion. Suitable arrangements should be put into place prior to delivery.

Vehicular Access

Due to the size and weight of some floorcoverings it is necessary to use large vehicles to facilitate their delivery.

We reserve the right to deliver to the nearest suitable point of access and will not be held responsible for any failed deliveries brought about through lack of vehicular access. Suitable arrangements should be put into place prior to delivery.

We do not under any circumstances issue refunds on goods that are unable to be delivered due to lack of vehicular access.

Cancellation

We strongly recommend the use of our free sampling service so that the nature, characteristics and functioning of the goods may be established prior to ordering.

We are unable to accept any cancellation of orders containing roll goods as these are cut to customers’ specifications.

Due to our quick turnaround times, orders for roll goods must be processed immediately. We are therefore unable to accept cancellation, even if the goods haven’t been delivered.

If, in the event that you require an amendment to your order, you contact us by telephone within one hour of your order being placed or by email, only if your order is placed after 5pm, at a weekend, or on a bank holiday, we will endeavour to stop the goods from being cut. This cannot be guaranteed as systems are automated.

Orders that do not contain goods that are cut or produced to customer’s specifications or are not screeds or adhesives, can be cancelled within 14 days of receipt by the consumer or another person identified by the consumer to take possession of them.

Goods must be unused, unopened and in a saleable condition.

Requests for cancellation should be made in writing.

Upon receipt of a request for cancellation, a handling charge will be calculated which will be deducted from any amount to be reimbursed.

The return of cancelled goods is the responsibility of the consumer. Goods must be returned to an address specified by us. In the case of cancellation, if the goods, by their nature, cannot normally be returned by post, the consumer will have to bear the cost of returning the goods.

It is the responsibility of the consumer to ensure that returned goods are received at the specified address in an unopened, undamaged and saleable condition. If goods are not received in such a condition, we reserve the right to make an appropriate deduction up to the contract price.

Refusal of Delivery

If delivery of the goods is refused without good reason we reserve the right to levy a charge for re-delivery.

Faulty Goods & Colour Matching

We strongly advise that all goods are thoroughly checked for faults before installation. Should any product be deemed faulty upon receipt it may be exchanged free of charge providing that the following course of action has been taken.

Goods that are damaged in transit should be signed for as damaged at the time of delivery on the carrier’s delivery note. You must then notify us of the problem by email as soon as possible. We will endeavour to arrange a replacement to be delivered as soon as possible and for the damaged goods to be collected. We will notify you when re-delivery and collection will take place. In the event that our carriers are unable to collect the goods on the arranged date a charge may be levied for their return.

If upon opening the goods a manufacturing fault is evident please contact us as soon as possible. We will endeavour to arrange a replacement to be delivered as soon as possible and for the damaged goods to be collected. We will notify you when re-delivery and collection will take place. In the event that our carriers are unable to collect the goods on the arranged date a charge may be levied for their return.

If after cutting into the goods or after fitting a manufacturing fault is evident you will be required to make a fitted complaint. Further information on fitted complaints would be provided at the time. This may involve a visit to the property by a representative from either our supplier, the manufacturer or an independent body.

If an accepted manufacturing fault is present, we are unable to reimburse fitting costs as all goods must be inspected prior to fitting.

Complaints relating to colour will not be accepted as free samples are available allowing you to inspect the colour of your chosen product before ordering. Please be aware that there may be slight variations between different production batches.

Whilst every effort has been taken to ensure that all photographs are representative of the actual goods we are unable to guarantee their representativeness due to various intractable variables such as differences in screen quality and settings which may cause images to appear differently on different devices.

Our Room Visualiser is intended to be used as a guide only. Colours and appearance cannot be guaranteed as representative of the actual goods.

Should you require multiple cuts of the same product to colour match please inform us of this at the time of ordering by using the notes/comments section of the checkout. We will endeavour to fulfil your request subject to sufficient stock being available. We will not be held responsible for multiple cuts not colour matching if no request is made at the time of ordering.

Governing Law

These terms are governed by English law and nothing in these terms is intended to affect your statutory rights.

Further Information

We strongly advise that you do not arrange a fitting date until you have received and checked your goods. We will not be held responsible for any loss incurred as a result of fitting being arranged before your goods have been received and checked.
